What we collect, how we use it, what your employer can and cannot see, and every right you have.

OnPoint BioHealth ("OnPoint BioHealth," "we," "us," or "our") is committed to protecting your privacy. This Privacy Policy (the "Policy") explains what information we collect about you, how we store, use, and share that information, and the rights and choices you have, when you use our website, our mobile application, our body-composition scanning services, our member marketplace, and related services (collectively, the "Services").
Please read this Policy carefully. By creating an account or using the Services, you acknowledge this Policy. If we make material changes, we will post the updated Policy here and, where required, notify you through the Services before the changes take effect.
Many members access the Services through a wellness program sponsored by their employer or another organization (a "Program Sponsor"). Where a Program Sponsor contracts with OnPoint BioHealth to make the Services available to its employees or members, the Program Sponsor determines certain aspects of the program, and OnPoint BioHealth processes information on the Program Sponsor's behalf for those purposes. For information you provide directly to us, such as your account details and your use of the app, OnPoint BioHealth determines how that information is used as described in this Policy.
Regardless of program structure, one commitment does not change: your individual health measurements are never disclosed to your Program Sponsor. Section 5 describes exactly what Program Sponsors receive.
Information you provide to us.
Information generated when you use the Services.
We do not knowingly collect precise geolocation, contacts, photos, or microphone data.
We may create de-identified or aggregated data by removing information that identifies you. We may use and disclose such data for any lawful purpose, including analytics and service improvement, and we commit not to attempt to re-identify it.
If you opt in to receive text messages from OnPoint BioHealth, we will send messages related to your account and program, such as scan reminders and program updates, at the frequency disclosed at opt-in. Message and data rates may apply. You can opt out at any time by replying STOP, and reply HELP for help. Consent to receive text messages is not a condition of any purchase. No mobile information or SMS opt-in consent will be shared with or sold to third parties or affiliates for marketing or promotional purposes.
Program Sponsors receive reporting about their program in aggregate, de-identified form only, such as participation rates, scan counts, engagement statistics, and population-level outcome trends. Every aggregate view enforces a minimum group size of five individuals, so that statistics for small teams or departments cannot be used to identify or infer information about any individual. This minimum is enforced at the database layer of our platform, not merely by policy.
Program Sponsors do not receive your individual scan results, your individual scores, your purchase history, or your identity in connection with any health measurement. Challenge leaderboards visible to Program Sponsors display only the nickname you choose.
We do not sell your personal information, and we do not share your personal information with third parties for their own marketing purposes. We share information only as follows:
Your information is stored on infrastructure located in the United States. We use administrative, technical, and physical safeguards designed to protect your information, including encryption in transit and at rest, per-user access controls enforced at the database level, role-based access for our personnel, and logging of administrative activity. No method of transmission or storage is completely secure, and we cannot guarantee absolute security; we will notify you and any applicable regulators of a breach as required by law.
We retain personal information for as long as your account is active and as needed to provide the Services, comply with legal obligations, resolve disputes, and enforce agreements. When information is no longer needed, we delete it or de-identify it. You may request deletion at any time as described in Section 9.
To exercise any right, email support@onpointbiohealth.com with the subject line "Privacy Request." We will verify your request using reasonable means and respond within the timeframe required by applicable law. We will not discriminate against you for exercising any privacy right.
California. If you are a California resident, the California Consumer Privacy Act, as amended, grants you rights to know, access, correct, and delete personal information, and to opt out of "sales" or "sharing" of personal information. The categories of personal information we collect are described in Section 2; the purposes are described in Section 3; and the categories of recipients are described in Section 6. We do not sell personal information and do not share personal information for cross-context behavioral advertising. We do not use or disclose sensitive personal information for purposes requiring a right to limit under California law. You may exercise your rights, or authorize an agent to do so, by contacting us as described in Section 9.
Texas and other states. Residents of Texas and other states with comprehensive privacy laws may have similar rights of access, correction, deletion, and portability, and the right to appeal a refusal. We honor such requests as described in Section 9; to appeal a decision, reply to our response and your appeal will be reviewed by a different member of our team.
The Services are intended for adults 18 and older. We do not knowingly collect personal information from anyone under 18. If you believe a minor has provided us personal information, contact us and we will delete it.
We may update this Policy from time to time. The effective date at the top reflects the latest revision. Material changes will be communicated through the Services or by other reasonable means before they take effect.
